Parties

This Rent-to-own Agreement  is made between Thierry Parent  (the “Seller”) and

__________________________________________________________ (the “Buyer”).

Goods

The Goods refer to a Helmet with added options listed in HCO. After the completion of payments set in Payment Plan the ownership of the Helmet will be transferred to the Buyer. The buyer will leave their current helmet with the seller. This helmet is returned to the seller if there is a breach of contract or when the payments have all been paid. It may be used for collateral when other payment issues occur, such as delays and incomplete payments. The balaclava provided with the helmet must always be worn when the helmet is used. The visor protector, fog film and tracking unit may not be removed.

Payments

Payments are set out in Payment Plan. If the helmet is damaged, this will constitute a breach of contract. If the Buyer fails to make payment before 9PM on the date the Buyer set out, this will be a breach of contract. Payment amounts cannot be changed without prior arrangements. If the buyer cannot meet these obligations, then it is considered a breach of contract. Payments must be made at a Capitec ATM/Pick n Pay to account 2384069280 (T. Parent) and cannot be included into other creditor’s payments. A payment is only accepted when a Proof of payment is sent.

Non-Payment and split payments

If you are unable to pay, the goods can be returned for safe keeping for the duration you need. Those goods will not be sold, just held until payment is made. You must initiate such payment holidays, do not wait until payment day elapses, as you will get a demerit, which puts at risk future Rent-to-own safety gear and motorcycles. The helmet cannot be kept when no payment is made.

If you do not pay and do not return the goods, we will be collect them at a cost of R4 per KM + R100 fee and held until they are fully paid along with the collection fee (for no more than 6 weeks at which time they are resold). If you pay less than the amount you accept above there will be a R20 fee for payment tracking per split or per postponement, so please stick to your plan, or let advise in advance to avoid it. The buyer returning the helmet does not constitute a breach, but seller collecting does.

 

Exiting the agreement

The buyer may exit the agreement at any time, by returning the Goods in good condition with no financial penalty. A return fee is charged up front and used to collect the helmet on cancellation. This fee is deducted from the last payment if contract is completed.

Should the buyer be involved in an accident, and be unable to use the helmet of work, the helmet need to be returned for spare parts and 50% of the value of remaining payments will be cancelled to assist the rider in recovery. If the helmet is not damaged, it will be collected and held for up to 6 weeks to give the buyer time to recover, after which it will return to the rental pool.

Theft and Loss

In the case of theft the helmet must be paid in full by the buyer, and the theft must be reported preferably immediately, but no later than within 24 hours. The buyer is required to report the theft and provide a case number to the seller.

Size and Swapping

A buyer may ask to swap their helmet for a different size within the 5 days, if the helmet is causing them pain, and the rental helmet is undamaged. Helmet swaps after that period must be done through cancellation of the contract, and starting a new contract.

Automatic termination

6 weeks after the last payment agreed upon on the payment annex, if the helmet is not paid in full for any reason, it will be repossessed without compensation by the seller from the buyer.

Usage

During the course of the contract the buyer agrees to the following:

  1. The helmet will not be leased or given to anyone else
  2. The helmet will not be changed, no alterations can be made to the helmet until fully paid
  3. The helmet will stored safely and upright when not in use
  4. The buyer will strictly adhere to the rules of the road and South African law, such as not skipping red lights or other dangerous riding.

 

Completion

Once all payments are completed, the Buyer may collect their old helmet and Bluetooth device (if not included) .If all payments were made on time the rider will be awarded with an additional balaclava and a helmet lining when collecting their old helmet. If the helmet was fitted with a tracking device, it is removed on completion.
